By accessing or using FireFolio ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
FireFolio is a financial independence planning product. The Service may include interactive FIRE scenarios, calculators, Journal field notes, persona stories, authenticated portfolio tooling, and optional connections to supported brokers. Features may change, be added, or be discontinued over time.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. To use certain features you must register. You agree to:
FireFolio provides educational tools, calculators, and informational content only. Nothing in the Service constitutes financial, investment, tax, legal, or other professional advice. Projections, scenarios, and calculator outputs are estimates based on assumptions you or we supply and may be incomplete or inaccurate. Past performance does not guarantee future results. You are solely responsible for your financial decisions. Consult a qualified professional before making investment or other financial choices.
You agree not to misuse the Service. Prohibited conduct includes, without limitation:
You retain ownership of planning inputs, preferences, and other content you submit to the Service ("User Content"). You grant FireFolio a worldwide, non-exclusive, royalty-free license to host, store, process, and display User Content solely as needed to operate and improve the Service. You represent that you have the rights necessary to provide User Content and that it does not infringe others' rights or violate law.
The Service, including its software, design, trademarks, Journal articles, and other materials we provide, is owned by FireFolio or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these terms, no license or ownership interest is transferred to you. You may not copy, modify, distribute, or create derivative works from our materials without prior written permission, except as allowed by law or by features of the Service that explicitly permit sharing.
The Service may integrate with third-party authentication providers, hosting platforms, and brokers. Your use of those services is subject to their terms and privacy policies. FireFolio is not responsible for third-party availability, accuracy, or conduct. Broker connections and any trading or account actions you take through a third party are between you and that provider.
Some links to broker sign-up pages are referral links. If you open an account through one, FireFolio may receive a fee from that broker. Referral links are labeled where they appear. Referral arrangements do not determine which brokers the Service supports, and nothing in the Service is a recommendation to open an account with any particular broker.
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that policy. If there is a conflict between these Terms and the Privacy Policy regarding personal data, the Privacy Policy controls for that subject.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CALCULATOR OUTPUTS OR OTHER CONTENT WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FireFolio AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
You agree to indemnify and hold harmless FireFolio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access immediately, with or without notice, if we believe you have violated these Terms, if required by law, or for any other reason we deem necessary to protect the Service or our users. Upon termination, your right to use the Service ends, and provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and indemnification) will survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms or the Service, except where prohibited by applicable consumer-protection law.
We may modify these Terms at any time. We will update the "Last updated" date on this page and, for material changes, provide notice by email or through the Service when reasonably practicable. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service.
These Terms constitute the entire agreement between you and FireFolio regarding the Service and supersede prior agreements on that subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
